The basic source of information on real property are:

 

  • Land and Building Register
  • Land and Mortgage Register

 

According to the Act of 17 May 1989 on Geodetic and Cartographic Law (Dz. U. of 2010, No. 193, item 1287, as amended) the Land and Building Register (real property cadastre) is uniform throughout the country and is a regularly updated collection of information on land, buildings and premises, their owners and other natural or legal persons who manage the land, buildings or premises.
Due to the purpose of the Land and Building Register, entries have mostly informative character. The Act does not provide any presumptions of compliance with the actual legal status, or any other substantive legal effect, which is realised by the Land and Mortgage Register.

 

The data included in the Land and Building Register are the basis of the relevant entries in Chapter I of the Land and Mortgage Register.

To obtain an extract from the registers, the investor should submit an application.

 

The legal status of a property can be checked in the Land and Mortgage Register. The register is public. It is available on the official website of the Ministry of Justice in an online Land and Mortgage Register.

Land and Mortgage Register consists of four sections:
Section 1 – basic information about the property and the right of ownership,
Section 2 – information on ownership and perpetual usufruct,
Section 3 – information regarding limited property rights with the exception of mortgages, restrictions regarding the disposal of property, perpetual usufruct and other rights and claims apart from claims relating to mortgages,
Section 4 – information on mortgages.
